Resistance to EPA Power Grab Gains Democratic Support

Landrieu.jpgIn September we highlighted how Sen. Lisa Murkowksi (R-AK), ranking member of the Senate Energy and Natural Resources Committee, had introduced an amendment to block the EPA from regulating CO2 under the Clean Air Act. That amendment was unfortunately squashed.

But Senator Murkowski is continuing this fight, and her efforts have now attracted the support of a key Democratic Senator: Mary Landrieu from Louisiana.

 The actual method for stopping the EPA's bureaucratic strangling of the American economy is still up in the air. As The Hill reports, Murkowski could offer an amendment to other legislation, or a "resolution of disapproval" to overturn the EPA's endangerment finding from last month.

The bipartisan effort of Murkowski and Landrieu eviscerates the arguments of Barbara Boxer, John Kerry, Nancy Pelosi, and the entire Obama administration, all of whom have claimed that if Congress does not pass a crippling new energy tax, the EPA will have to regulate CO2, with devastating results for the American economy.

Clearly, that isn't the case: Congress can put the EPA in its place.

And as we've pointed out before, Congress has actually already limited the scope of what EPA can do with regard to regulating CO2 earlier this year with legislation.

EPA was created by Congress, is funded by Congress, and can be controlled by Congress. The idea that 535 elected officials in the legislative branch are powerless to their own creation is simply absurd, and it flies in the face of the fundamental American principle of representative government.

Who holds power in America, the people or an unelected bureaucracy?

One more note: Cap and trade passed Barbara Boxer's committee with zero Republican votes, yet the current effort to rein in the EPA is already a bipartisan effort.
